Buyer' agent fradulently misrepresented financial qualifications?
I am selling my house right now and I am in contract with another house. I just found out that the buyers agent LIED that his client is well qualified. I chose this buyer over another potential buyer since she said he was well qualified. I find out I was low-balled on my appraisal and I was asked to go way down in price. I did and now I am waiting in limbo for over 3 weeks now with this buyer. I got woof of emails that this buyer was not qualified to buy my house from his mortgage officer. This buyer should have never been in my house over-bidding. Now I might be losing the other house since I am on contingency and I just found the house I want to buy were not inform that my deal will not go through. They are having a moving sale soon and they have no clue what is happening. I have invested somewhat like $1500 for inspections, septic tank insp, loan app and appraisals on that house. I did this thinking my buyer was well qualified. Apparently not. What recourse do I have. Can I go after the buyers agent for damages and suffering done. We are so devastated in all this. There is so many people it will affect. My family and the family of the sellers of the house I want are going to be affected horribly. Its a total nightmare. Can I sue the buyers agent for misrepresentation. I am in NYS. He had a pre-qualification letter. Plus I have an email from his loan officer that he was not qualified to buy my house. Somehow I got this email. Oh I have an agent who is number 1 expert. The loan officer of the buyer said he was looking in the wrong price range. What idiots they were even thinking of coming into my house when both of them knew they couldn't afford it.
